Terms of Service

1. Acceptance
By using swerver ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.
2. Service description
Swerver is a technology platform that provides API gateway proxy services with x402 HTTP payment protocol integration. The Service enables API providers to monetize endpoints via per-request payments and facilitates settlement between payers and providers through third-party payment processors.
Swerver is a technology provider. We are not a bank, financial institution, money transmitter, or payment processor. We do not hold, custody, or transmit funds. Payment processing is handled by Stripe. Payment facilitation is handled by x402.org. Settlement occurs directly between payers and providers through these third-party services.
3. Accounts
You are responsible for maintaining the security of your account credentials and wallet addresses. You must provide accurate information when creating an account. You are responsible for all activity that occurs under your account.
4. Payments and fees
Platform fees are charged as a percentage of each x402 settlement, determined by your plan tier. Fees are deducted before settlement payouts. Subscription fees for paid plans are billed monthly via Stripe. All fees are non-refundable unless required by applicable law.
5. USDC and blockchain risks
The x402 protocol uses USDC (a stablecoin) for payments. By using the Service, you acknowledge and accept:
- Blockchain transactions are irreversible once confirmed
- Network congestion may cause delays in settlement
- Gas fees are borne by the paying party and are non-refundable
- Stablecoin value may fluctuate relative to fiat currencies
- You are responsible for providing correct wallet addresses; funds sent to incorrect addresses cannot be recovered
- Regulatory changes may affect the availability of USDC or blockchain-based payments in your jurisdiction
6. API provider obligations
If you use the Service to monetize an API, you represent and warrant that:
- You own or have the right to distribute the content and services accessible through your API
- Your API does not serve illegal, harmful, or infringing content
- You comply with all applicable laws in the jurisdictions where your API is available
- You will respond promptly to abuse reports related to your API
7. Intellectual property
You retain all rights to your APIs, content, and data. We claim no ownership over content transmitted through the Service. We retain rights to the swerver platform, software, and brand.
8. Acceptable use
You must not use the Service to:
- Proxy or distribute illegal content, including CSAM
- Facilitate fraud, money laundering, or sanctions evasion
- Distribute malware or conduct cyberattacks
- Infringe on intellectual property rights
- Violate applicable laws or regulations
We reserve the right to suspend or terminate accounts that violate these terms without notice. To report abuse, contact abuse@swerver.net.
9. Indemnification
You agree to indemnify and hold harmless Swerver from any claims, damages, or expenses arising from your use of the Service, including content served through your APIs, violations of these terms, or infringement of third-party rights.
10. Limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for upstream API outages, blockchain network delays, failed transactions, stablecoin value fluctuations, or loss of funds due to incorrect wallet addresses. To the maximum extent permitted by law, our total aggregate liability is limited to the fees you have paid in the preceding 12 months.
11. Dispute resolution
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. Claims must be brought individually; class actions are not permitted. Small claims court is available for qualifying disputes.
12. Termination
Either party may terminate at any time. Upon termination, pending settlements will be processed and paid out within 30 days. We may suspend or terminate accounts that violate these terms without notice. Sections 5, 9, 10, and 11 survive termination.
13. Changes
We may update these terms. Continued use after changes constitutes acceptance. Material changes will be communicated via the email associated with your account at least 30 days before taking effect.
